Agreement to Terms

By submitting a quote request or entering into a rental agreement with MCM Rentals (a division of MCM Group / MCMCO CC), you agree to be bound by these terms and conditions. Please read them carefully before proceeding.

Rental Agreement

All equipment rentals are subject to a formal rental agreement that will be provided upon confirmation of your booking. The rental agreement will specify the equipment, rental period, rates, delivery details, and terms specific to your project.

Rental Rates and Payment

  • All prices quoted are in South African Rand (ZAR) and exclude VAT unless stated otherwise.
  • Rental rates are based on the equipment type, duration, and delivery location.
  • Payment terms are specified in the individual rental agreement.
  • A security deposit may be required before equipment delivery.
  • Late returns may incur additional daily charges at the applicable daily rate.

Equipment Use and Care

  • Rented equipment must be used only for its intended purpose and within its rated capacity.
  • The renter is responsible for the safe operation and security of the equipment while on hire.
  • Only trained and authorised operators may use the rented equipment.
  • The renter must comply with all applicable South African health and safety legislation (OHS Act).
  • Any damage, loss, or theft of equipment during the rental period is the renter's responsibility.

Delivery and Collection

MCM Rentals will deliver equipment to the agreed site location. The renter is responsible for ensuring safe and adequate access for delivery and collection vehicles. Delivery times are estimates and may vary based on location and availability.

Maintenance and Support

Routine maintenance and servicing are included in the rental rate. The renter must report any equipment issues immediately via our 24/7 support line. Damage caused by misuse, negligence, or unauthorised modifications is not covered.

Insurance

The renter is responsible for obtaining adequate insurance coverage for the rented equipment during the rental period. MCM Rentals can provide details of recommended insurance providers upon request.

Cancellation

  • Cancellations made more than 48 hours before delivery: no charge.
  • Cancellations made within 48 hours of delivery: a cancellation fee may apply.
  • No-show or refused delivery: full first-day rental charge applies.

Limitation of Liability

MCM Rentals liability is limited to the rental fees paid for the specific rental period in question. MCM Rentals is not liable for any indirect, consequential, or incidental damages arising from equipment rental or use.

Governing Law

These terms and conditions are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of the Western Cape.
